QUIT CALLING!!  Reply with quote

I have been receiving call from credit card companies at 8 to 9o'clock at night. This is so frustating. These guys have some nerve. I don't know what list I ended up on but a lot of credit card companies seem to have it. Is there anyway to find out how or who gave my information to these people?

I'm not sure how you would find out now, but I have heard of people that use a different middle initial (when they can) when they have to give out their personal information. Then when they see junk mail or get a call for "John Z. Public", they can tell roughly how their info was "leaked".

I'd recommend that you ask these tele-marketers for their company name, and ask them to remove you from their list. I think by law, they are supposed to do so. Good luck with it...

FDCPA states that lawfull hours for collection efforts are between 8am and 9pm, this seems to match your discription farely well. have you ever thought that maybe they are trying to collect on a substantial debt that you owe?

Re Harassing and Threatening Phone Calls From Your Company
Greetings:
Please limit your communication with me to writing only. If I receive any telephone calls from your company, I will consider them to constitute harassment. Please be advised that unwanted telephone calls are a class 1 misdemeanor in this state and I will file a complaint against the caller with the attorney generals office. I maintain a telephone log of each phone call and in some cases, make an audio recording when necessary.
Send me a copy of your “written policy” for maintaining a “do not call” list. The Telephone Solicitation Act requires that such policy be made available upon demand. This Federal statute imposes a $500 fine against unwanted telephone solicitation. I do not want you to call me. If you do call me, you agree to pay, on a for-hire basis, my telephone equipment and time in answering your call at a rate of no less than $500 per call.
Be advised that you have the right to remain silent. If you ignore this notice and contact me by telephone, you and your employees agree to allow me to make an audio recording of our conversation and you and your employees agree to allow the recording and any other information to be used against you and your employees in a court of law. I will accept only your written communication.

Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a "validation;" that is, competent evidence that I have some contractual obligation to pay you.

You should also be aware that sending unsubstantiated demands for payment through the United States Mail System might constitute mail fraud under federal and state law. You may wish to consult with a competent legal advisor before your next communication with me.

Your failure to satisfy this request within the requirements of the Fair Debt Collection Practices Act will be construed as your absolute waiver of any and all claims against me, and your tacit agreement to compensate me for costs and attorney fees.
Best regards,

Re unwanted, threatening and harassing phone calls
Greetings:
Please help me to resolve this problem. I have tried to address it myself but my requests go unanswered. [Individual calling] from [creditor/collector] continually calls me demanding payment of money I have already paid. They refuse to correct the problem and have been calling me, almost every day, making threats about garnishing my wages or closing my bank accounts. Sometimes they call me numerous times in the same day, even at work. It's like they think they can do anything they want. Is this illegal?

[Individual calling] said he (or she) could garnish my wages any day unless I sent payments immediately. He (or she) asked me to fax and then mail five pre-dated checks or the company would begin garnishing my wages. Can they do this?

Please help me if you can, as soon as possible.
Best regards,
[Sender]

If these calls are based on debt collection, then I'd refer you to this website:

unwanted phone calls  Reply with quote

If the calls are solicitations, simply hang up. Don't say "No thanks;" don't say "Please don't call me," don't demand names and addresses. Just hang up. Again and again. For as long as it takes.

If, on the other hand, they are trying to collect a past-due debt, I'd say they are well within their rights. Bring your account current, and the calls will almost surely cease.

Caller ID helps. If you own your own home and bought it with the phone number you use know, it is probably public record, so changing it would stop a lot of calls

If you have any young children in the house, you could give them the phone.

When my daughter was 3, 4 and 5 she would talk and talk and talk!

And if that is not an option, you could always tell them to hang on a minute, put the phone down and watch tv or do the dishes or whatever it was you were doing.

Come back 20 minutes later and say, OH, I am so sorry, this is not a good time for me and hang up.

They will still be there. AND while they are on "HOLD" with you, they can't call someone else! Very Happy

I got $50 once from MBNA calling after 9PM.

I asked ot speak with a manager. I informed the manager that I'm in Colorado and it is after 9PM.

He informed me that the computer should not have called my phone number after 9 and that I would have a $50 credit on my next statement.

Well, the next time I asked for a manager the underling panicked and hung up on me!!!

Some of these new telemarketers give up way to easy.

You can't even play with them 'cuz they hang up.
