What are the sales tax laws on an online business?  Reply with quote  

My business would not ship any actual product. It is a service business. People would purchase a membership and have access to my services. So, what are the sales tax laws for that type of online business?

Sales tax laws are a state-by-state issue. Technically speaking, if you have a "presence" (good luck getting a court to pin that down) in any state that has a sales tax that you're supposed to collect sales taxes as appropriate to that state's laws and send them to that state. Practically speaking, unless you're a big online seller (like Dell, for example) I wouldn't worry about it. It wouldn't be right for me to advise you to disregard other state's laws. But, like I said, I wouldn't worry about it. Read between the lines. Laughing

You should also get registered with the states taxation authority(get a tax ID number) and learn your filing requirements. Keep good records and possiblly you can claim a home office and computer.This advice was prepared based on our understanding of the tax law in effect at the time it was written as it applies to the facts that you provided.

I registered my company a few months back, at that time I fulfill the all requirement & now I don't have any type of tension.

As per your business description you are not required to collect sales tax from your client.

his is state question and look at your states dept of taxation to see what services are taxed. You should also get registered with the states taxation authority(get a tax ID number) and learn your filing requirements. Keep good records and possibly you can claim a home office and computer.
