hi everyone, i have 2 concerns:

1) my employer deducted my 1/1/05 to 1/15/05 401k contribution..however, they have not funded my account. this is the 2nd time this has happened...1st time, they say they "forgot" to sign the check..unbelievable! this time they say they did, but the 401k administrator say they don't have the fund.

some of my friend say to report to DOL...im still thinking about it. what are some of the repercussions if i do report my small-business company(only 5 employees)?

2) they recently transfer to a new plan administrator as of march 1, 2005. but my contribution from 2/1 to 2/15 still has not been deposit to my old plan admin...again, they say they did, but when i called the plan admin up, they say no funds deposited.

i tried my best to contact my employer, but i always get a run-around...always returning my phone calls/emails 1 week later.

please advise what i need to do? thanks

Disenroll from your 401k plan and gently (and I do mean gently) continue to seek proof of these claimed remittance(s) to the plan administrator.

Your employer's payroll department (or payroll services contractor) is either incompetent or there is deliberate malfeasance going on.

Your job and the salary it pays are the number one priority here. Do not complain to the Department of Labor or anyone else in any official capacity or in any official forum.

This is America. Unless your job is unionized please understand that your employer holds all the cards. If you are identified as a trouble maker, that could mean the end of you. A 401k without a salary has no usefulness to you.

Hear me well. This is deadly serious advice.
