| The same Corporate name as another Corp. in different state? |

I have been using a trade name for my business for a little while, now and want to incorporate it. I have found that there is another company that would have the same corporation name in another state. Is it okay for me to incorporate in another state with the same business name? Are there any laws against it?

I'd suggest you want to find out if their name is a trademark or service mark, whether it's registered or copyrighted. I'm sure they'll tell you if you contact them.

i also suggest u to choose different name of your business because u will have to face difficulty in future because always trademark registered is valid for all over country not for state indivisdully........

Three points:
1) don't resurrect old threads and especially when you have nothing to add

It is common to find the same name used by another business in a different state. When you form a corporation in your state, states only require that the corporation name be distinguishable (ie. different) from the names of other corporations and/or other business entities that are registered in the state of incorporation.

It does against the laws ,for instant you can't register another KFC in one place,further more you just can't pick the name that too close to the one that have resisted either if you carry the some type of business,for example GFC ..Check out more at your local law firm.
